Privacy Policy – myKinCloud

This privacy policy (“Privacy Policy”) describes how your personal information is collected, used and shared when you visit or make a purchase from myKinCloud (“myKinCloud,” “us,” "we" or “our”). myKinCloud is committed to protecting and respecting your privacy in connection with your use of our application, website www.mykincloud and other services and features thereof (collectively referred to herein as the “App”), which may be updated from time-to-time at the sole discretion of myKinCloud. This Privacy Policy and any other documents referred to herein set forth the basis on which any personal information we collect from the account owner (“Account Owner”),  invited profile (“Invited Profile”) or added profile (“Added Profile”), (collectively, “Profile” or “Profiles”), in connection with the App will be processed by us. Please read the following carefully to understand our practices regarding your personal information and how we will collect and use your personal information.

Personal Information we collect

When we refer to personal information (“Personal Information”) in this Privacy Policy, we are referring to both Account Information and Device Information.

 

Account Information:
We collect the information and content that the Account Owner provides for themselves, and also the information and content that Profiles provide, when registering for and using the myKinCloud App, including registration information, content and communications shared on the App and activity on the App.

 

  • Registration information: This includes information that the Account Owner provides when they create a myKinCloud account for themselves that may include their child(ren), such as names, birthdates and any account login details (including email and password). In addition, Added and Invited Profiles might provide their names, birthdate and any account login details (including email and password). We also collect information about consents that the Account Owner provides to approve their child(ren)'s myKinCloud profile and activity.

  • Content and communications: We collect the content and information that the Account Owner and Profiles send and receive on the App, such as the content from features within the App, including text and photos.

  • Activity: We also collect information about how the Account Owner and Profiles use the App, such as who they engage with, what features they use and how long and in what ways they engage with different features on the App.

 

Device Information:

When you use our App, we collect information from or about the phone or another device where the App is installed. This includes, for example, information about the operating system, hardware version, device settings, device identifiers and connection information such as the name of the mobile operator or ISP, language and time zone, and IP address. We do not track your geolocation.

Communications and Third-Party Links

As an Account Owner or Profile you must opt-in to subscribe to newsletters, marketing or promotional materials and other information we may send. You have the opportunity to opt-in when creating the Account, or by subscribing within Settings on the App, as long as you are 13 years of age or older.  No communications are available to Profiles under 13 years of age. 


There are no third-party links to external websites or apps and there are no cookies in our Services.

Sharing your Personal Information

We do not sell or rent your Personal Information to advertisers or third parties, and we do not share information that directly identifies you (such as your name, email address or other contact information), nor do we share any content that you post on or through our Service, with advertisers or third parties. We use a third party analytics service for tracking general usage for improving product services and marketing. Your Personal Information may be accessed by other third-party service providers that support our business, such as companies that provide technical infrastructure or support.


All partners must adhere to strict data confidentiality and security obligations set out in the agreements that we enter with them (such as compliance with data privacy and protection laws and maintenance of administrative, physical and technical safeguards to prevent unauthorized access or disclosure of data) that are consistent with this Privacy Policy, including obligations to only use the information that we provide for the performance of the services we specify.

We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

The myKinCloud App is designed to provide a private environment where adults and their children can share and connect. The Account Owner who creates the group profile has control over whom is invited or added into their private group on the App, where the group can communicate with only those who are invited or added. These approved family and friends can see profile information about, and content received, from the private group with whom they are connected. This can include the profiles' names, usernames and content including text and photos that are shared with the private group.

 

You are responsible for maintaining the confidentiality of your Account and password, including but not limited to the restriction of access to your computer and/or Account. You agree to accept responsibility for any and all activities or actions by all Profiles that occur under your Account and/or password, whether your password is with our Service or a third-party Service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account. The credit card information you provide is always encrypted during transfer over networks.

Electronic communications

If you opt-in to receive promotional materials from us via email, either at Account creation, or following the instructions within Settings, we will use the information you give us to provide the communications you have requested. If there are children included in the group, we do not collect their email addresses and do not send promotional materials to them. If you inform us that you wish to cancel email promotional materials by selecting “unsubscribe” at the bottom of such communication, we will remove you from our mailing list. If you no longer wish to receive push notifications, you may turn them off at the device level.

Minors

The myKinCloud App is designed to be used by both adults and children, but you must be 18 years of age to be the Account Owner for the App. Only the Account Owner can add or invite other Profiles to join the private cloud. Only individuals over the age of 13 can be Invited Profiles to join the private cloud. Individuals under the age of 13 may be Added Profiles to the App only with the involvement and consent of their parent or legal guardian, the Account Owner. This relationship is affirmed during “Add a Profile’ where the Account Owner must check a box to confirm that they are the parent or legal guardian of the minor in order to proceed with adding said profile. 

Your rights

You have the right to access Personal Information we hold about you and to ask that your Personal Information be corrected, updated or deleted. If you would like to exercise this right, please contact us through the contact information below.  

 

A parent or guardian who has authorized the myKinCloud App can see their child(ren)'s interactions on the App by accessing the account that they set up for the private group. In order to stop further collection and use of Personal Information on the App, the Account Owner can delete Profiles, including a child(ren)’s profile. If an account is deleted, we will delete the account’s registration information and information about their activity and device information, as described above. However, the messages and content that was sent to and received from others before their account was deleted may remain visible to the remaining users in the private group.  

If necessary, for legal compliance or other legitimate needs described by the policy, all information may be retained in a hashed/de-identified format.

 

CCPA: Under the California Consumer Privacy Act, (AKA the “CCPA”), "personal information" is any information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular California resident or household. 

Subject to certain exceptions, California residents have the right to make the following requests, at no charge, up to twice every 12 months:

Right of Deletion: California residents have the right to request deletion of their personal information that we have collected about them, subject to certain exemptions, and to have such personal information deleted, except where necessary for any of a list of exempt purposes.

Right to Know – Right to a Copy: California residents have the right to request a copy of the specific pieces of personal information that we have collected about them in the prior 12 months and to have this delivered, free of charge, either (a) by mail or (b) electronically in a portable and⎯to the extent technically feasible⎯readily useable format that allows the individual to transmit this information to another entity without hindrance. 

Right to Know – Right to Information: California residents have the right to request that we provide them certain information about how we have handled their personal information in the prior 12 months, including the categories of personal information collected, the sources for that personal information, the purpose for collecting and selling personal information and to whom we have disclosed that information.

If you would like to have your information deleted or if you would like to exercise your rights under the CCPA to a copy, and/or the right to information we have, please contact us via email at support@mykincloud.com. We will respond to verifiable requests received from California consumers consistent with California law.

California Eraser Law. If you are 18 and a California resident, and you discover an image posted on our App taken when you were a minor, the California Eraser law allows you to have us remove the image from view, pursuant to your request.  Should you request removal, please be advised that it will be removed only from those sites under our control, and for privacy purposes, we may ask you to verify your request.

Changes

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
